Welcome to Wasatch Gallery. These Terms of Service govern your access to and use of our website, online store, products, artwork, services, and related features.

Throughout these Terms, “Wasatch Gallery,” “we,” “us,” and “our” refer to Wasatch Gallery. “You” and “your” refer to any visitor, customer, purchaser, collector, or other person who accesses or uses our website or services.

By visiting our website, purchasing a product, submitting an order, or otherwise using our services, you agree to these Terms of Service. If you do not agree with these Terms, please do not use the website or place an order.

1. About Wasatch Gallery

Wasatch Gallery is an art gallery and online retailer offering original artwork, fine-art prints, limited-edition prints, open-edition prints, commissioned artwork, and related products.

Certain artworks may be created by independent artists represented or featured by Wasatch Gallery. Certain prints or other products may be produced or fulfilled by carefully selected third-party printing, framing, shipping, or fulfillment partners.

2. Eligibility and Use of the Website

You may use this website only for lawful purposes.

By using this website or placing an order, you represent that you are legally capable of entering into a binding agreement in your jurisdiction.

You agree not to use our website to commit fraud, interfere with the operation or security of the site, attempt unauthorized access, transmit malicious code, infringe intellectual-property rights, scrape or reproduce website content without authorization, or engage in unlawful or abusive activity.

We reserve the right to refuse service, cancel orders, suspend access, or restrict use of the website where reasonably necessary to protect Wasatch Gallery, our artists, our customers, or our systems.

3. Artwork and Product Descriptions

We make reasonable efforts to present artwork, prints, dimensions, materials, framing, colors, and product descriptions as accurately as possible.

However, artwork is inherently visual, and the appearance of colors may vary depending on your screen, monitor calibration, lighting, device settings, printing process, substrate, and surrounding environment.

Images displayed on the website are therefore intended to represent the artwork as accurately as reasonably possible but are not a guarantee of exact color reproduction.

For original artwork, minor surface texture, brushwork, impasto, visible artist marks, natural irregularities, and variations are part of the artwork and are not considered defects.

For reproductions and prints, slight differences in color, cropping, scale, texture, border placement, or image positioning may occur as part of the printing and production process.

4. Original Artwork

Unless otherwise stated, an original artwork is a unique physical work of art.

Availability of originals is subject to change. An original may occasionally sell through another gallery, exhibition, artist studio, or sales channel before our website inventory is updated.

If an original artwork becomes unavailable after an order is submitted, we may cancel the order and refund all amounts paid for that artwork.

Purchase of an original artwork transfers ownership of the physical artwork only.

Copyright and all reproduction rights remain with the artist or applicable copyright owner unless expressly transferred in a separate written agreement.

5. Fine-Art Prints and Reproductions

Wasatch Gallery may offer open-edition prints, limited-edition prints, signed prints, archival pigment prints, giclée prints, canvas prints, paper prints, and other reproductions.

Print specifications, dimensions, materials, edition information, signature details, and production methods will be identified on the applicable product page when relevant.

Actual printed dimensions may vary slightly due to trimming, production tolerances, stretching, mounting, or framing.

Some products may be printed or fulfilled after an order is placed.

6. Limited Editions

Where an artwork is identified as a limited edition, the stated edition size refers to the maximum number of numbered prints intended for that edition, subject to any separately identified artist proofs, printer proofs, exhibition proofs, or similar customary proof categories.

Limited-edition numbers may be assigned according to availability and may not necessarily be shipped sequentially based on order date unless specifically stated.

Unless expressly promised on the product page, purchasing a limited-edition print does not entitle the buyer to select a particular edition number.

7. Artist Signatures

Where a product is described as artist-signed or hand-signed, the signature will be applied by the artist unless otherwise disclosed.

Signature placement, size, pressure, ink, pencil tone, and appearance may vary slightly because each signature is made individually.

Such variations are normal and are not considered defects.

8. Framing

Where framing is offered, product photographs and digital room mockups are intended to provide a reasonable representation of the final presentation.

Because frames, mats, glazing, mounting materials, and handcrafted components may vary slightly, minor differences in wood grain, finish, tone, texture, joins, or dimensions are not considered defects.

Unless otherwise stated, measurements for framed artwork are approximate.

9. Commissions and Custom Artwork

Commissioned and custom artwork may be governed by additional terms, estimates, invoices, artist agreements, approval procedures, or deposit requirements.

Any additional written commission terms provided for a particular project will supplement these Terms of Service. If there is a direct conflict, the specific written commission agreement will control for that project.

Because original commissioned artwork involves a creative process, the finished work will reflect the artist’s judgment, interpretation, technique, and style.

Digital mockups, reference photographs, preliminary sketches, studies, color concepts, and compositional previews are planning tools and do not guarantee that the finished original artwork will match them exactly.

Unless otherwise agreed in writing, estimated completion dates are estimates rather than guaranteed delivery dates.

10. Prices

All prices are listed in U.S. dollars unless otherwise stated.

Prices may change without notice.

The price displayed at the time an order is successfully placed will generally apply to that order, subject to correction of obvious errors.

We reserve the right to correct typographical errors, pricing errors, incorrect discounts, incorrect product information, or technical errors.

If a material pricing error affects an order, we may contact you for approval of the corrected price or cancel the affected item and issue a refund.

11. Taxes

Applicable sales tax or other transaction taxes may be calculated and collected based on the shipping destination, applicable law, and the capabilities of our ecommerce and payment providers.

You are responsible for any taxes, duties, import charges, brokerage fees, customs fees, or similar governmental charges not collected at checkout where applicable.

12. Orders and Acceptance

Submitting an order does not necessarily mean that the order has been accepted.

We reserve the right to accept, decline, limit, or cancel an order for legitimate business reasons, including suspected fraud, inventory errors, pricing errors, payment issues, shipping restrictions, duplicate orders, artwork availability, or technical problems.

An order is considered accepted when payment has been successfully processed and the order has entered fulfillment, unless otherwise communicated.

13. Payment

Payment must be made through the payment methods offered at checkout.

Payment processing may be handled by third-party payment providers. Your use of those services may also be subject to the provider’s separate terms and privacy practices.

You represent that you are authorized to use the payment method submitted with your order.

14. Shipping and Delivery

Shipping times are estimates unless we expressly guarantee a delivery date in writing.

Original artwork may require special packaging, crating, insurance, freight arrangements, or additional preparation time.

Prints may be produced to order and may therefore require production time before shipment.

We are not responsible for delays caused by carriers, severe weather, natural disasters, customs, incorrect delivery information, labor disruptions, or circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate delivery address.

15. Risk of Loss and Delivery

Responsibility for loss or damage will be determined in accordance with applicable law and the shipping arrangement used for the particular order.

Customers should inspect artwork promptly upon delivery.

Visible shipping damage should be documented immediately with photographs of the artwork, shipping container, packaging materials, labels, and damaged areas.

Please contact us promptly so that we can evaluate the damage and, where appropriate, work with the carrier, insurer, artist, printer, or fulfillment provider.

Do not discard damaged packaging until the matter has been resolved.

16. Returns and Refunds

Returns, exchanges, cancellations, and refunds are governed by our posted Refund Policy.

The Refund Policy forms part of these Terms of Service.

Certain custom-made, commissioned, personalized, altered, or special-order products may have different return restrictions where permitted by law and where disclosed before purchase.

Nothing in these Terms limits any non-waivable consumer rights provided by applicable law.

17. Intellectual Property

The artwork, photographs, product images, videos, text, logos, trademarks, graphics, designs, branding, website layout, and other materials appearing on this website are protected by copyright, trademark, and other intellectual-property laws.

Unless expressly authorized, you may not reproduce, copy, distribute, publish, modify, sell, license, create derivative works from, commercially exploit, or otherwise use our website content or artwork images.

Purchasing artwork does not transfer copyright.

The purchaser acquires ownership of the physical artwork or print purchased, but does not acquire the right to reproduce, publish, license, merchandise, tokenize, digitally distribute, commercially exploit, or create derivative works from the image.

All such rights remain with the artist or applicable rights holder unless expressly transferred in writing.

18. Photography of Purchased Artwork

Collectors may photograph purchased artwork for reasonable personal and noncommercial purposes, including displaying the artwork in their home, documenting their collection, or sharing photographs on personal social media.

Such permission does not include high-resolution reproduction, commercial publication, merchandise production, print reproduction, licensing, digital asset creation, or other commercial exploitation.

19. Artist Copyright and Moral Rights

Where applicable, participating artists retain their copyrights and any other rights afforded to them under applicable law.

Wasatch Gallery respects the intellectual-property rights of its artists and expects customers and website visitors to do the same.

20. Trademarks

“Wasatch Gallery,” our logo, branding, product names, slogans, including Art That Elevates, and other identifying marks may constitute trademarks or proprietary brand assets.

Nothing on the website grants permission to use these marks without prior written authorization.

21. Website Images and Room Mockups

Room scenes, scale illustrations, digital mockups, framed previews, lifestyle photographs, and virtual visualizations are provided for presentation purposes.

Perceived scale may vary depending on screen size, room dimensions, furniture proportions, cropping, photography, or rendering.

Customers should rely on the stated artwork dimensions rather than visual mockups when determining actual size.

22. Third-Party Services and Fulfillment

We may use third-party services for ecommerce hosting, payment processing, printing, framing, shipping, analytics, communications, and fulfillment.

Shopify notes that merchants remain responsible for their customer relationship and should disclose relevant third-party supplier arrangements.

We are not responsible for the independent acts or omissions of third parties except to the extent required by applicable law.

23. Third-Party Links

Our website may contain links to third-party websites, social-media platforms, payment providers, artists, galleries, shipping providers, or other services.

We do not control those websites and are not responsible for their content, availability, security, privacy practices, or terms.

Accessing third-party websites is at your own discretion.

24. Reviews, Testimonials, and Submitted Content

If you submit a review, testimonial, photograph, comment, or other content to Wasatch Gallery, you represent that you have the right to provide that content.

Unless otherwise agreed, you grant Wasatch Gallery a nonexclusive, royalty-free license to reproduce and display the submitted content for reasonable gallery, website, social-media, promotional, and marketing purposes.

We reserve the right not to publish or to remove content that is unlawful, fraudulent, abusive, defamatory, infringing, misleading, or unrelated to the relevant product or service.

25. Privacy

Your use of our website is also governed by our Privacy Policy.

Our Privacy Policy explains how personal information may be collected, used, disclosed, and protected.

Shopify recommends that ecommerce merchants maintain appropriate privacy disclosures, and privacy obligations can depend on the jurisdictions and scale in which the business operates.

26. Website Availability

We aim to keep the website accurate and available but cannot guarantee uninterrupted or error-free operation.

We may modify, suspend, update, discontinue, or restrict portions of the website without notice where reasonably necessary.

27. Disclaimer of Warranties

Where liability cannot legally be excluded, our liability will be limited only to the extent permitted by applicable law.

Nothing in these Terms limits liability where such limitation would be prohibited by law.

29. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Wasatch Gallery and its owners, employees, contractors, artists, and representatives from claims, losses, liabilities, damages, and reasonable costs arising from your unlawful misuse of the website, infringement of another party’s rights, or violation of these Terms.

30. Governing Law

These Terms and any transaction with Wasatch Gallery will be governed by the laws of the State of Utah, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

31. Disputes

We encourage customers to contact us first if a concern arises. Most issues involving artwork, shipping, printing, or fulfillment can be resolved directly.

Before initiating formal legal proceedings, the parties agree to make a reasonable good-faith effort to resolve the dispute informally.

Any additional dispute-resolution, venue, arbitration, or court provisions should be interpreted only to the extent permitted by applicable law.

32. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

33. No Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision later.

34. Entire Agreement

These Terms, together with our Refund Policy, Privacy Policy, Shipping Policy, and any applicable written commission or purchase agreement, constitute the agreement governing your use of the website and purchases from Wasatch Gallery.

35. Changes to These Terms

We may update these Terms from time to time to reflect changes in our business, services, policies, technology, or applicable law.

The current version will be posted on this page with the date of the latest revision.

Your continued use of the website after revised Terms become effective constitutes acceptance of those revised Terms to the extent permitted by law.
